Design law

Design law (or design patent law) includes all legal issues dealing with the protection and imitation of aesthetic forms and designs. Typical examples are furniture design, fashion design, car body designs and also product parts. 
Design protection does not always require formal registration as a German design or European Community design. An EU-wide design protection can also arise through work creation (copyright protection according to the UrhG) or disclosure in the European Union (non-registered Community design according to the CDR). Under certain circumstances, there may even be protection according to the principles of supplementary protection under competition law under the Unfair Competition Act (UWG). 
We assist our clients in obtaining design protection before the German Patent and Trademark Office (DPMA), before the European Union Intellectual Property Office (EUIPO) and before the World Intellectual Property Organization (WIPO). We also advise and act for our clients in the assertion of rights and claims arising from design rights and in the licensing of designs. 
Our activities in the field of design law (design patent law) include, among others: 
  • Registration and protection of designs and design patents in Germany, Europe and on an international level
  • Warning letters, cease-and-desist declarations, preliminary injunctions and lawsuits with the aim of obtaining injunctive relief, destruction, information, damages, recall, etc. (e.g. in cases of design imitation and product piracy, unauthorized use, etc.)
  • Licensing and contract law (control, negotiation and drafting of e.g. design licenses and transfers)
  • Design protection according to supplementary protection under competition law and protection under copyright law
